Tort of Negligence Essay Example | Topics and Well Written Essays - 2750 words

Tort of Negligence - Essay ExamplePer say the concept of negligence doe not make to an act. Actually it is a legal concept that tends to define the basic character of an act so as to prove it to be legally wrong. As per Blyth vs. Birmingham waterworks Co. (1856), Negligence is the omission to do something which a reasonable humanness, guided upon those considerations which ordinarily regulate the conduct of human affairs, would do, or doing something which a prudent and reasonable man would not do. However, once the concept of negligence came within the scope of the English Tort Law, the next logical and plausible challenge was to decide as to what qualifies to be termed as ordinary care and what was to be the nature and basis of the measure required to decide as to whether an act committed by an individual, organization or a group amounted to negligence. In that context, one needs to mention the much famous concept of the man on the Clapham heap. ... The man on the Clapham Omnibu s represented a hypothetical person who is in everyday reasonable and well educated without being qualified enough to be called a medical specialist (Twining 64). The man on the Clapham Omnibus represented the standard of reasoning with which to gauge a defendants conduct in an English Law civil Action for Negligence. The hallmark of this concept was that it delineated and put in place a standard for ascertaining and establishing the charges of negligence on a defendant. It established a general standard of care expected of any English citizen while performing varied aspects of ones personal or professional life. The real viewer of this standard is that it tends to be reasonable yet simple in its approach and tends to bring the legal concept of negligence within the grasp and scope of the so called common man. The very fact that this standard of care does not expect perfection on the part of ascertainers obliterates any possibility on the part of the defendants to sprain out of the clutches of law by resorting to technical jargon and rigmarole. It is also immensely humane and pragmatic in the sense that it do recognizes the fact that an medium person lacks the foresight to foresee any risk accruing by the dint of ones actions. Still, it is astutely responsible and practical in the sense that it enjoins on the honest person the duty to be ordinarily prudent and careful, without tending to be unexceptionally or unrealistically flawless. There is no denying the fact that even the most fighter experts in jurisprudence do tend to overlook and appreciate the sophistication and beauty inherent in the concept of the man on the Clapham Omnibus. However, the verity is that this legal idiom not only validated the concept

Racial Prejudices Research Paper Example | Topics and Well Written Essays - 750 words

Racial Prejudices - Research Paper ExampleAccording to Allport (1954), definition of prejudice is a negative bias directed to a particular congregation of people. On the hand, racism is has a foundation on beliefs and shown in behaviors that believes race to be a biological entity and claims some other racial groups obscure from their own are psychologically, intellectually and physically inferior (Allport, 1954). Pascoe (1985) describes racism that it results from race prejudice transformation and ethnocentrism through power exercise against another racial group regarded as inferior by institutions and individuals with unintentional and intentional support of the whole culture. at that placefore, the racism core includes prejudiced mentality of superiority in a in group with a power exercise to subjugate a group considered out. Therefore, as prejudice is attitudinal in nature mainly, racism extends the attitude into a tell apart behavior against another group. Many theorists ha ve tended to explain why racial prejudice is easy to develop. Some claim that racial prejudice is one of the by-products of development for adaptive strategies for survival that make humans beings to distinguish between a foe and a friend (Oskamp, 2000). Furthermore, the process of natural selection programmed the human adept to depend on physical markers in assessment of a potential threat among competing incompatible racial groupings. This perspective is echoed in prehistoric societies where interpersonal interactions among different tribes were noted to be dangerous in transmission of deadly diseases (Allport, 1954). Adaptive reactions to these threats were to attribute a potential threat to people of an out group who were identify by different physical features. From this perspective, racism and prejudice can be and has been embedded in the cultural, biological and social collective human consciousness. Pascoe (1985) points out that some scholars have conceptualized the psyc hodynamic of psychological processes thought to explain racial prejudice development and maintenance among the whites. The conceptual perspective views racial prejudice as an unconscious swelled head mechanism for defense designed for reduction of anxiety among most experience of white people due to conflicted super ego and id based racial feelings and thoughts (Oskamp, 2000). There are different sources of racial prejudice key among them are various forms of fear. The expectation that another person will do harm , perception that the others difference in viewing the world will create to ones own challenges, presumption that by interacting it will lead to rejection, doubt or ridicule and the fear generation of negative consequences due to negative stereotypes. According to Allport (1954), the theoretical support that suggests forcing of people to change their behaviors will results to a yearn term in change of attitude relates to the theory of cognitive dissonance that stipulates that people cannot think in a particular way and contrarily exercise in a manner without interfering with the belief structure. Therefore, according to Pascoe (1985), two strategies can work to this problem First, attention should be paid to the normative drive to change behavior as contrary to legal pressure. Second, steps to be taken to make sure that the moral pressure conveyor is someone respected, akin(predicate) to the target. Oskamp (2000) adds that strategies that try to change the

Iconology, Image, art and people - Essay ExampleAs such, it is well known and universally accepted that art has played a rudimentary role in shaping the modern society as it is today and continues to assert its influence. In the most earliest times, the expression through art was in truth primitive. Our ancient forefathers used to carve murals fork uping scenes such as hunting and different wild animals by scratching out on rocks with the help of knifelike and pointed stones. As man organized himself into an organized and civilize society, the mediums through which art began to be expressed started to take on many forms. It started to develop into a super skillful and representational aspect of work and evolved into a study of its own. People now required to be highly trained in order to be able to produce pieces of art that could be considered as valuable to the society. As art evolved, it began to capture increasing aspects of our lives and the expression started to look increa singly expressive. it started to gain numerous perspectives in terms of anatomy, the kind of materials used, the combination of colors as well as in terms of the content. However, as newer movements began to rise all over the centuries, they began to slowly disrobe the expression of any meaning. Such social entropy was necessitated with the greed to make people happy. This required that true information be masked with content that seemed to depict something more appealing to the masses. The current paper aims to discuss the impacts of the history and evolution of art on society and aims to derive it further in the direction of Iconography, which is a broad domain of art history in its own sense. The next sections will discuss the growth and development in the interpretation of art over the ages and will discuss iconology and its evolution over the centuries. As has been mentioned above, the paper will attempt to discuss how we have come to

MEDIA ANALYSIS - Essay ExampleFor example when the photograph of Miriam is introduced to the priest, he quickly jumps to the conclusion that Elijah is guilty of the sexual assault however upon learning more information one quickly learn that he is the least belike to be the one guilty of the crime. The record structure takes on a kind of ratchet formula in which the story quickly takes steps former only to immediately takes a step back which is a common theme across many detective shows. In regards to how the narrative structure is plot around moments of disruption there are frequent incidences that centre on this theme. For example one can quickly identify the deception from Elijah as he originally escapes from the police, when The Devil quickly assaults Detective Elliot Stabler in the bathroom. What these actions imply is that there is a relative moment of tranquility before the aforementioned incidents and it is the case that this affects the narrative insofar as it causes momen ts of excitement.Lastly there is the case of issues of resolution. Whilst several resolutions were in fact brought about they brought with them severe consequences. By having Elijah identifies The Devil of Ghulu it in fact would set down resolution to the countless people that he harmed but will cost Elijah his freedom. By having Miriam identify the war criminal she in fact can booster aide in his conviction however she would bring about her own unpleasant feelings. By Elijah taking refuge in the Church he in fact eliminates his chances of ever gaining American citizenship. Information processing Essay Example for Free

Information touch on EssayDiscuss how tuition covering varies between person, squad and racquet athletics. skylark contains mainly perceptual motor skills so it is important to select the correct skill for the situation. The surgical operation used to select the correct skill is c totallyed the information processing system or the DCR process, because we Detect information, Comp be it with precedent experiences and then react.Welford said that all information is taken in as stimuli through our senses. It is then stored in the go around term memory board before being sorted, if the stimulant drug is relevant to the current skill then it is stored in the short term memory where it is compared to previous experiences in the long term memory. Then a finale is do as to what legal action to take based on this comparison. The action that was performed and the outcome from this action are then stored in the long term memory for future reference.Welfords model is shown below This model makes a performer react in the room that they do to a situation further there are many factors that tramp influence what action the performer decides to take. These include eon available, number and warmth of stimuli, experience, anticipation, fitness and motivation of the performer. The effect these factors nourish on a performer will vary from individual, racquet and team sports. The time that you make available to process the incoming stimuli differs in individually sport. For warning in rugby, which is externally paced, you have a small amount of time to process the stimuli and make a decision because there are usually many defenders around you. Tennis frauds also have very little time to react because the clunk is usually traveling at a high speed and if they dont make a decision and return the ball they will lose the point. However in golf, an internally paced sport, the player can take as long as they need to make a decision because there are no opponent s directly around them. in that location are three main types of stimuli that enter the sensory input these areVision is where a player will react to a visual stimulus such as the position of the ball or an opponent. These stimuli are easier to detect and react to if the stimulus is brighter. For causa in tennis the ball is bright xanthous which makes it easier to see. But there are also unwanted stimuli such as ball boys moving or crowd movements these stimuli are obviously extraneous but they are still initially taken in which slows tidy sum the whole process. In an individual sport there are fewer visual stimuli for warning in a 100m race the only real visual stimulus is where the finish line is in relation to you.Audition this is all stimuli that are heard, for example when a team mate calls for the ball in rugby. Auditable stimuli are hard and processed easier and faster if they are loud and clear. There are also irrelevant auditable stimuli such as crowd noise these will slow down the information processing model.Proprioception this is made up of three componentsEquilibrium this is an awareness of your remains position and balance. We can tell if we are about to fall over and where we are in relation to objects. Team sports are more likely to have an uneven playing surface which means that your balance will have to be constantly adjusted as you are running. But in individual and racquet sports the playing surface is fairly constant with the exception of golf, where a stance may have to be altered to adjust to the surface.Kinaesthesis this is where the luggage compartment senses the muscle movement and contraction it is sometimes known as muscle memory. It is if the movement feels right to the performer. It is developed through practice and experience one example would be a conversion kick in rugby the player may take there step away from the ball in the very(prenominal) way they usually do but they may just feel that they are not in the right pla ce. It doesnt apply as more than in team games as in individual and racquet sports apart from set plays.Tactile sense this is the feeling of pressure this is important for all sports. It can be affected be the weather conditions because cold weather affects our ability to feel effectively. The short term sensory store is where all information is stored for a dampen second before it is processed. All relevant and irrelevant information is stored in here before it is replaced and lost. This does not differ between sports only what enters it does. The perception format is where all the information that has come from the short term sensory store is processed. This is when irrelevant information is thrown away and useful stimuli such as where the ball is, is kept to make a decision and stored in the STM. This will vary between individual, racquet and team sports because of the amount of stimuli. In team sports there are more stimuli so it takes longer to sort through whereas there are r elatively small amounts of stimuli in individual sports so it wont take as long to sort them out. It also differs depending upon whether the performer is experienced or not as it will be easier for a expert to sort through the stimuli because they have more experience. We sort through the stimuli with selective attention and take only the important pieces of information because only around 7-10 pieces of information can be stored in the STM.The information passed on from the perception stage is then stored in the STM. Because only 7-10 pieces of information can be stored an experienced player may chunk information together so that the position of all players is one piece, but a beginner may not be able to do this so each player may be a separate piece. Team sports would be much more affected because of the amount of information so not all stimuli can be stored so a poor decision may be made but less(prenominal) poor decisions will be made in an individual or racquet sport because th ere is less information. The LTM holds information on movement patterns and the results of using them in certain situations and can hold them for a lifetime. Team sports have many memories but individual sports may have less. The decision making process is where whats happening now (in the short term memory) with what has happened previously (in the long term memory). In the LTM the performer will be looking for similar situations and actions and their outcomes. This makes team games decision making process a lot longer because of the vast amount of information and possible actions to take. Whereas in an individual sport there is much less information and less possible actions. The motor output is the performance of the chosen skill. One example may be for a badminton player to put in a falloff shot because the opponent is at the back of the court. The action is referred to the muscle movement in the LTM. The action and its consequences are then stored in the long term memory for futu re reference.Individual sports, because they are individually paced, make them the simplest in the IP model. Also because there are fewer stimuli there is a shorter reaction time which gives the performer more time to carry out the IP model which should result in a better decision.Racquet sports are externally paced ascribable to the fact that there is an opponent this means that there is less time for the performer to react. There are some irrelevant stimuli which will slow down the IP model which means it takes longer to decide than in an individual sport but not as long as in a team sport because there are fewer possibilities for what action to take.Team sports are externally paced which reduces the time available to react. Also there are much more irrelevant stimuli in team sports, this will lengthen the IP. The IP will also be lengthened due to the complexity of most team games because there are more situations and possible responses to choose from.BibliographyAdvanced PE for Edexcel Heinemann by F. The Artist Essay Example for Free

The Artist Essay hear what smooch Feeding is in cinema. What example did we watch in class? The actor in that film spoke four words to the camera what are those words? How did the speaking of those lines spoon feed what was obviously depicted prior to that dialogue? Spoon feeding in cinema is a device used by directors to plainly state to the audience exactly what happened. Sometimes it may be obvious, much(prenominal) as the example we watched in class. Schwarzeneggers character, Dutch says aloud after the Predator passes him over, He couldnt enamour me. The audience has certainly already realized that the predator couldnt see him. This sort of device has the ability to be used artistically tho in this case it rattling Just seems a little belittling to the audience. 2- Describe the use of eubstance language in Peter and the Wolf, how was this achieved in the film? Peter and the Wolf, being a silent film, depended largely on character body language to illustrate concepts. Each character was specifically defined in their motions. Peter was curious and sneaky. You could sense caution in the way that he travel and looked at things- the eyes were in truth telling. The duck, carefree and goofy, flipped, flopped, and plopped all over the place. The wolf was dangerous yet noble, his posture was very(prenominal) distinct. The music in the film helped to hit the roof that body language. 3- Describe the scenes and what form of communication is depicted when pretense is revealed in 2001 a space odyssey and One flew over the Cuckoos nest 2001 Pretense is revealed when the two workforce speak in secret piece in the pod. HAL, notwithstanding being cut off from audibility of the other two, is still able to see the men speaking. All sound in the film cuts off and the camera zooms in to the mens lips oving, panning back and forth between the two mens conversation. Not knowing that he washstand see them, they continue to conspire against HAL as he reads their l ips. OFOTCN The most obvious pretense in One Flew would be head words unveiling to Mac that he does hence speak and can understand everything around him. The men sit on a bench awaiting treatment and Mac offers Chief a stick of gum. He takes it and thanks him. In Macs moment of bewilderment Chief goes on to say Ah, Juicy fruit. To which Mac is simply overjoyed. The difference between the two being that unity Describe director Stanly Kubricks use of the absence of sound used in 2001 a space odyssey Kubricks use of lock is all too relevant in 2001. With so many long drawn issue shots of the ship, he does well to remind the audience that the scene is set in space. Space, by nature, is a vacuum cleaner and for that is void of all sound. This really helps to put the audience up there with the astronauts. In many scenes which he doesnt use are those involving the processes of HAL.It kind of suggests that he is wintry and collected. He is not a human with a heartbeat. His processes are silent. Looking back on the cene where HAL witnesses the other two astronauts speaking secretly the audience hears nothing. This lull is his processing. Its his cold logic and elaborates planning of what to do in order to preserve himself. 5- Describe director John doormans use of sound in Hell in the Pacific. Describe Jane Campions use of sound in The Piano. What kinds of sounds do both films have in common? I absolutely loved the sound used in Hell in the Pacific.Much of it was so wild and chaotic, not dissimilar the trapped mens situation. doorman embellished the sound of water in several instances waves crashing, water droplets, rain. Its probably whiz of the most important props in the film after all, you cannot live very long without water. Campion used music very creatively to establish setting and give characters a means of expression. Ada would play, Baines would lust after her music, Flora would sing. Both films, though portray water in very deliberate ways. The Pi ano begins and ends with the main characters crossing over water to a new home.It seems like the water is trapping Ada here on this island and the freshman indication of what would be a difficult Journey is the wave crashing upon her and the piano bandage she played it on he beach. This scene is similar to the one in which the Japanese man, while on lookout, had water crash through his fort, if you will call it that. 6- Billy and Flora While the two characters serve very incompatible purposes in their respective films they are alike in that they have very childlike attitudes. Flora actually is a child and her actions are expected of one of her age.Billy, on the other hand, possesses the shyness and demeanor that a child might but it is most likely attributed to his mental affliction. The two both wear their emotions on their sleeve. Flora very vividly xpresses her disapproval of Ada attempts to contact Baines through her and goes so far as to, twice, betray her own mother. Billy is easily bear by social situations, is often seen in The Piano entertaining herself. She has a wild imagination and will talk to Just about anyone. Billy tends to run around the other patients but is still well reserved. He has nervous tendencies stuttering, lack of eye contact, closed off body language. Another stark subscriber line between our two youthful characters is that they lie on opposite sides of their respective communication spectrum. Flora acts as a translator for Ada. When Ada wants to be hear she signs to Flora and Flora speaks for her, whereas it seems as though Billy is the one that needs a voice in One Flew. An example of this is during the therapy session when he is all the way uncomfortable and would rather not speak on the subject. It is here that another patient speaks up and suggests that maybe Billy doesnt want to talk about this item subject. 7- Stewart and Nurse Ratched Two intriguing characters. They are both antagonists to their stories but both seem unaware, at least outwardly that that is their place. Their antagony does not seem to be lay though. Nurse Ratched is the head nurse I think her character is a little deeper than Stewarts. It seems there are many levels to her. Initially she appears as a just well-kept nurse. She is soft spoken yet direct in her tone.It later becomes more apparent that she is more controlling than one might have ab initio thought. The ward is her world. What she says goes. And even when the patients play her game she always is the victor the vote, for instance, despite there being Just enough votes to trump her she still refused the boys the baseball game. Its really hard to say whether she is really truly bad though. As head nurse it is her Job to maintain absolute order. In a facility such as the setting she is right to say that even the slightest change would potentially provoke certain patients to cause a difficult situation.Steward, on the other hand, despite his wealth and position he doesn t have complete control. He wants control but Adas will is too strong. Stewart goes to great efforts to try to keep her caged but she prevails. so far when he violently cuts off her finger she does waiver. unconstipated Stewards anger and upset (not necessarily his actions) are understandable. He has brought Ada over to marry him and love him but ever for a moment is this what she wants. Hes frustrated but he truly does try to make her happy. When he cannot please her he falls apart. Ada and the Chief The most obvious similarity is the characters silence the two share. You do at most point in both films get the experience the voice of the characters Ada, while she narrates the beginning and end of the film and Chief, while he and Mac patiently wait for their punishment and enjoy a stick of gum together. While the Adas and the Chiefs silence is chosen I feel that Chiefs is more of free will than Adas silence. The Chief only adopted silence as a way to protect himself while in the institution. Ada accustomed to it not only as a habit but as a lifestyle.Youth is when you develop your personality Even in the film it is evident that Chief is effluent in his speaking abilities. When Ada begins to speak again she has a difficult time because she simply never learned to do it well. They both seemed to be hiding themselves somehow. Its unsure exactly what might be affecting Ada, maybe a childhood event of some sort. It does seem clear that Chief is affected by two clashing assimilations. His mother is white nd his father native American. His father lost himself in alcohol, he is clearly affected. 9- Mac and Baines Mac and Baines are both deviants to their cultures. They have both been shunned and placed outside of society on one way or another. Baines seemed to have disagreed with his own culture so much he went so far as to remove himself completely from it. He actual mingled into the Maori culture, the natives of the land. In this culture some of the social mores of the colonial white culture are accepted with open arms. Baines is a very emotionally expressive character and he chose to unite an expressive culture. Mac is most certainly deviant. But where Baines is more of an introverted deviant Mac displays extroversion in spades. He comes from a workhouse. He was kicked out for getting into a fght with another worker. He chose to run with the verdict that he was crazy because it meant that he would not have to go to Jail. They are both very sexual. Baines provokes a sexually driven relationship between an initially unwilling Ada. He knows what he is doing is unacceptable and its certainly done in secret. Mac, our Type A personality has no qualms about keeping his sexual life and desires out in the open. He has no discretion in discussing it and is very eager in encouraging others, such as Billy to do the same.
